These Terms & Conditions (“Terms”) govern bookings and participation in trips offered by Summits & Adventures, LLC d/b/a Beyond The Ride (“Beyond The Ride,” “we,” “us,” “our”). By making a booking or participating in a trip, you agree to these Terms and the policies incorporated by reference below.
Acceptance: During checkout you will be asked to check a box confirming that you have read and agree to these Terms, the Waiver, the Cancellation Policy, and the Privacy Policy. You may also be required to create an account on our website in order to complete your booking, provide traveler information, and complete required forms before or after purchase. Checking the acceptance box, creating or using your account for booking purposes, or completing payment constitutes your electronic signature and acceptance on behalf of yourself and any Travelers you book for.
Policies incorporated by reference: The following documents are part of your agreement with us and are incorporated by reference (the “Policies”): Waiver of Liability, Assumption of Risk, Release, Indemnity, and Forum Selection Agreement (the “Waiver”), Cancellation Policy, and Privacy Policy. If there is any conflict between these Terms and a Policy: (a) the Waiver controls for safety, assumption of risk, releases, indemnity, and dispute forum; (b) the Cancellation Policy controls for cancellations and trip credit; and (c) the Privacy Policy controls for personal data processing. We will also comply with any mandatory consumer, tourism, or safety laws that apply in the country or region where the Trip is operated. Where such laws grant you non-waivable minimum rights, those rights will apply in addition to these Terms.
Definitions: “Trip” includes any tour, ride, camp, retreat, excursion, transportation, lodging, companion activity, cultural activity, support service, or other experience sold, arranged, coordinated, or supported by us anywhere in the world. “Traveler” means any person participating in a Trip. “Booking Party” means the person completing the booking and payment. “Account” means the user profile or login credentials created or used on our website to make a booking, manage a booking, submit traveler information, or complete required forms or documents.
Eligibility and authority to book: Bookings may be made only by individuals age 21 or older. If you book for other Travelers, you represent that you have authority to accept these Terms on their behalf, to create or manage booking-related account access where applicable, and to ensure that each Traveler reviews and accepts the Policies, including signing the Waiver and any required minor forms when applicable. Some Trips may have additional minimum age requirements and conditions for minors. These details will be described in the Trip information or during the booking process.
Account registration and information accuracy: To complete a booking, access booking details, or submit required traveler forms, you may be required to create and maintain an Account on our website. You agree to provide accurate, current, and complete information during account registration, booking, and completion of required forms, and to promptly update that information if it changes. You are responsible for maintaining the confidentiality of your login credentials and for all activity occurring under your Account, except to the extent caused by our own misconduct or failure to use reasonable security measures. We may suspend, restrict, or terminate access to an Account, or deny participation in a Trip, if we reasonably believe that account information, traveler information, or required forms are incomplete, inaccurate, misleading, unauthorized, or inconsistent with safe Trip operations.
Payment terms: Payment in full (100%) is due at the time of booking unless we expressly agree otherwise in writing. If partial payment was used, then the balance is due 30 days prior to the start of the Trip, unless we specify a different date in writing. All prices are in U.S. dollars (USD) unless stated otherwise. If a payment fails, is reversed, or is charged back, we may cancel the booking at our discretion. You remain responsible for amounts owed plus any reasonable costs we incur due to the reversal (for example processor fees and collection costs).
Required documents and participation requirements: Participation requires acceptance of these Terms and execution of the Waiver (and any applicable minor forms). We may also require you to create or use an Account and provide certain information reasonably needed to operate the Trip, including emergency contact information, bike sizing, traveler details, health- or safety-related disclosures, and other required forms or documents before or after booking. If a required form is not completed, if required traveler information is missing, if required insurance is not maintained, or if requested information is not provided through the booking process or Account when required, a Traveler may be denied participation in all or part of the Trip. If a Traveler is denied participation due to missing required documents, incomplete required forms, missing information, inaccurate booking information, or lack of required insurance, refunds are not provided. Any trip credit, if applicable, is governed solely by the Cancellation Policy.
Cancellations, refunds, and trip credit: our Cancellation Policy applies to all bookings. In summary, because we commit to accommodations, bicycles, and local services well in advance, all payments are non-refundable and non-transferable, and eligible cancellations may receive trip credit based on the timing of the cancellation. If Beyond The Ride cancels a Trip before departure, trip credit (if selected) is generally valid for 18 months from the original departure date, unless a longer period is required by law. Trip credit terms, scope, and usage are described in the Cancellation Policy. We are not responsible for third-party costs you book independently (for example flights, personal hotels, visas, or other arrangements not booked through us or our partners).
Itinerary changes, weather, and force majeure: Trips operate in real-world conditions. Routes, schedules, accommodations, support plans, and included activities may change due to weather, safety, road conditions, operational considerations, illness, government action, civil unrest, natural disasters, transportation disruptions, or other events outside our control (“Force Majeure”). We may, at our discretion, modify routes, start times, ride distances, daily schedules, accommodations (of comparable standard when possible), substitute activities, delay, shorten, or suspend portions of a Trip for safety or operational reasons. These changes do not create a right to refunds. Any credit (if applicable) is governed solely by the Cancellation Policy.
Trip nature: Trips are recreational experiences. Times and performance are not measured. Individual outcomes depend on many factors including fitness, weather, road conditions, and personal choices.
Health, fitness, and safety responsibilities: Cycling and adventure travel involve significant physical effort and may be demanding. You confirm that you are in suitable physical condition and that you have no condition that prevents safe participation. If you have any medical condition, injury, or concern that could affect your safe participation, you agree to consult a medical professional before booking or participating. You agree to follow instructions from organizers and support staff, ride responsibly, comply with local traffic laws, and wear a helmet whenever riding. You acknowledge that riding occurs on public roads and you will be sharing the road with other vehicles, and that hazards may be present. You agree not to ride while impaired by alcohol, drugs, medication side effects, illness, fatigue, or any condition affecting safety. Certain medical conditions, disabilities, or special requirements may require prior evaluation. Please contact us before booking to confirm whether we can reasonably accommodate specific needs. We cannot guarantee accommodation in all locations, especially in remote or resource-limited destinations.
Assumption of risk and waiver: You understand that the Activities are inherently risky and may result in serious injury or death. You voluntarily choose to participate. Your full assumption of risk, release, covenant not to sue, indemnity obligations, and dispute forum are set out in the Waiver, which is incorporated into these Terms. Nothing in these Terms limits any non-waivable rights you may have under applicable law.
Travel insurance and medical costs: Travel medical insurance covering adventure activities, including road and/or gravel cycling, is required. You are responsible for obtaining and maintaining appropriate coverage, including medical expenses and emergency medical evacuation and repatriation. You are responsible for medical costs, rescue, evacuation, transportation, and related expenses as described in the Waiver. We strongly recommend additional travel insurance that covers trip cancellation, interruption, and delay, particularly given that our Cancellation Policy does not provide cash refunds.
Third-party providers: Trips may involve third-party providers such as travel agencies and operators, local operators, guides, drivers, hotels, restaurants, activity vendors, and transportation providers. Some of these third parties are independent contractors and are not our employees or agents. Your Waiver extends protections to the Released Parties as defined in the Waiver, which include certain third-party providers involved in the planning and delivery of the Trip.
Accommodation and room arrangements: Private accommodation is provided for each cyclist, unless otherwise stated in the Trip description. If a cyclist travels with a non-cyclist companion booked in the same party, the cyclist and the companions will share the same room unless we expressly confirm a different arrangement in writing. Companion accommodation and any additional room requests depend on availability and the selected trip and may affect pricing. Final room configurations are confirmed in your booking confirmation.
Photography, video, and testimonials: Photos and video may be captured during Trips. By booking, you grant Beyond The Ride the right to use your likeness, voice, and content for marketing and promotional purposes worldwide, in any media now known or later developed, without compensation, unless prohibited by law. If you do not want to be featured, notify us in writing before the Trip. We will make reasonable efforts to honor the request, but we cannot guarantee exclusion from all incidental footage or group scenes. You may withdraw consent for future use of your individual photos, videos, or testimonials by contacting us. Where we control the content, we will make reasonable efforts to stop using it going forward and to remove it from channels we control, where feasible and consistent with applicable law.
Privacy: Our collection and use of personal information are governed by our Privacy Policy, including information collected through account registration, booking forms, traveler forms, payment processing, cookies, Meta Pixel, and related website technologies, as well as limited sharing with service providers, local authorities, and insurers when required for booking operations, coverage, or claims handling. By creating an Account, making a booking, or participating in a Trip, you acknowledge that you have reviewed the Privacy Policy.
Website content and no guarantees: Trip descriptions, itineraries, photos, and FAQs are provided for general information and may change. Itinerary information and FAQs do not guarantee specific outcomes, exact routes, exact bike models, or exact inclusions unless expressly stated in your written booking confirmation. Limitation of liability for travel-related losses: To the maximum extent permitted by law, Beyond The Ride is not liable for indirect, incidental, consequential, special, or punitive damages, including lost enjoyment, lost time, missed connections, airfare changes, lodging booked independently, or lost wages. Nothing in these Terms limits liability where a limitation is prohibited by law.
Governing law, informal resolution, and exclusive forum: These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, to the fullest extent permitted by law. Before starting any lawsuit or similar proceeding, the parties agree to attempt to resolve the dispute in good faith by written communication, and, if both sides agree, by participating in a voluntary online mediation. This informal process does not prevent either party from seeking urgent relief where appropriate. Any dispute arising out of or relating to these Terms or a Trip must be brought exclusively in the courts specified in the Waiver (Harris County, Texas, or the applicable federal court with jurisdiction over Harris County, Texas), subject to any non-waivable rights you may have under applicable law.
Additional terms for residents of the European Union and the United Kingdom: This Section applies only to bookings that constitute a package under applicable package travel laws and that are sold or offered by Beyond The Ride directly to a traveler who is resident in a Member State of the European Union or in the United Kingdom at the time of booking. For bookings covered by this Section, Beyond The Ride acts as the organizer of the package for purposes of applicable package travel law to the extent required by such law. Nothing in these Terms, the Waiver, the Cancellation Policy, or any other booking document is intended to exclude, waive, restrict, or limit any mandatory rights or remedies that a traveler may have under applicable package travel or consumer protection laws of the European Union or the United Kingdom, including rights that cannot legally be waived or limited by contract. To the extent of any conflict, such mandatory rights shall prevail. For bookings covered by this Section, Beyond The Ride is responsible for the proper performance of the travel services included in the package, regardless of whether such services are to be performed by Beyond The Ride or by third-party suppliers, except to the extent that applicable law provides otherwise. If, after the start of the Trip, a significant portion of the package cannot be provided as agreed, Beyond The Ride will, where required by applicable law, offer suitable alternative arrangements at no extra cost to the traveler and, where appropriate, provide any required price reduction, refund, or compensation. If the traveler is in difficulty during the Trip, Beyond The Ride will provide such assistance as is required by applicable package travel law, which may include appropriate information on health services, local authorities, consular assistance, communications, or alternative travel arrangements. If Beyond The Ride is prevented from performing the package because of unavoidable and extraordinary circumstances, or if Beyond The Ride cancels the package before the start of the Trip in circumstances where applicable package travel law requires a refund, the traveler will be entitled to the refund required by such law. Where applicable law permits compensation to be excluded in such circumstances, no additional compensation shall be due beyond what the law requires. If unavoidable and extraordinary circumstances occur at the destination or in its immediate vicinity and significantly affect the performance of the package or the carriage of passengers to the destination, a traveler covered by this Section may have the right to terminate the booking before the start of the Trip without paying a termination fee, to the extent provided by applicable law. If Beyond The Ride makes a significant change to the main characteristics of the package before the start of the Trip, or increases the total price beyond the threshold permitted by applicable law, the traveler will have the rights provided by applicable law, which may include the right to accept the change, accept a substitute package if offered, or terminate the booking without a termination fee and receive a refund as required by law. A traveler covered by this Section may transfer the booking to another traveler who satisfies all conditions applicable to the package, provided reasonable notice is given on a durable medium before the start of the Trip. Beyond The Ride may charge only those transfer fees, costs, or expenses that are permitted by applicable law and that do not exceed the actual cost incurred. Any termination fees, cancellation charges, or deductions applied to a traveler covered by this Section shall be subject to applicable package travel law and shall be limited to those that are appropriate, justifiable, and lawful under the circumstances. For bookings covered by this Section, any references in these Terms or related Policies to trip credit as the sole remedy shall not apply where applicable package travel law requires a cash refund, price reduction, compensation, alternative arrangements, assistance, or any other mandatory remedy. Beyond The Ride will provide travelers covered by this Section with any pre-contract information and standard package travel rights information required by applicable law, including any standard information form required for package travel, in the booking flow, by link, or on another durable medium. Beyond The Ride will maintain such insolvency protection for bookings covered by this Section as is required by applicable package travel law to the extent such protection is legally and practically available to Beyond The Ride as a Texas-based organizer selling directly into the relevant market. If additional market-specific booking conditions, acknowledgments, or notices are required in order to implement such protection or comply with applicable law, those additional terms may be presented during the booking process and will form part of the booking contract. This Section does not create rights for any traveler who is not otherwise entitled to protection under applicable package travel law, and it does not expand Beyond The Ride’s obligations beyond those imposed by applicable mandatory law.
Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.
Changes to these terms: We may update these Terms from time to time. The version in effect at the time of your booking applies to your booking, unless a change is required by law or is necessary for safety or operational reasons.
